The judiciary has turned to alternative dispute resolution to deal with its chronic court backlog, but accusations of constitutional violations have turned the decision into a battleground.
A constitutional crisis has been sparked by South Africa’s introduction of mandatory mediation to unclog its civil courts. A directive published on 22 April this year by the Office of the Judge President for the Gauteng Division of the High Court of South Africa introduced mandatory mediation for dispute
