{"id":39328,"date":"2025-11-18T13:00:28","date_gmt":"2025-11-18T13:00:28","guid":{"rendered":"https:\/\/www.cdr-news.com\/?p=39328"},"modified":"2025-11-27T10:59:19","modified_gmt":"2025-11-27T10:59:19","slug":"gcas25-abolishing-class-actions-would-be-cowardly-says-gutmann","status":"publish","type":"post","link":"https:\/\/www.cdr-news.com\/categories\/litigation\/gcas25-abolishing-class-actions-would-be-cowardly-says-gutmann\/","title":{"rendered":"GCAS25: Abolishing class actions would be \u2018cowardly\u2019 says Gutmann"},"content":{"rendered":"\n<p><strong>Class representative Justin Gutmann said the UK should show \u2018global leadership\u2019 in class actions, saying delays were an inevitable growing pain and defending the role of third-party funding.<\/strong><\/p>\n\n\n\n<p>Justin Gutmann has called for those involved in UK class actions \u201cto stand up and be counted\u201d and resist the campaign to abolish or diminish the opt-out regime.<\/p>\n\n\n\n<p>Giving the opening keynote address at the Global Class Actions Symposium, hosted by <em>CDR<\/em> parent company Global Legal Group, in London this morning (18 November), Gutmann said collective redress was essential to consumer protection.<\/p>\n\n\n\n<p>The class representative in the <a href=\"https:\/\/www.cdr-news.com\/categories\/competition-business-crime\/train-operators-victorious-in-boundary-fares-wrangle\/\"><em>Boundary Fares<\/em><\/a>, <a href=\"https:\/\/www.cdr-news.com\/categories\/third-party-finance\/industry-welcomes-crucial-apple-funding-ruling\/\"><em>iPhone<\/em><\/a> and <em>Handsets<\/em> claims, Gutmann acknowledged that the regime is \u201cnot perfect\u201d, but said it was too soon to draw conclusions about a 10-year-old regime that was still in its developmental stage.<\/p>\n\n\n\n<p>The relatively slow progress of cases to date was \u201cthe inevitable result\u201d of cases being \u201cfiled at the early development of the regime and consequently subjected to the delays caused by waiting for decisions of the CAT [Competition Appeal Tribunal], the Court of Appeal and the Supreme Court\u201d. His own recently concluded <em>Boundary Fares <\/em>claim was delayed for a year by the need for a precedent from <a href=\"https:\/\/www.cdr-news.com\/categories\/competition-business-crime\/cat-approves-merricks-settlement\/\"><em>Merricks v Mastercard<\/em><\/a>,<\/p>\n\n\n\n<p>Gutmann said abolishing the regime would be \u201ccowardly\u201d and counselled the government against using the <a href=\"https:\/\/www.cdr-news.com\/categories\/litigation\/uk-to-review-opt-out-class-actions-regime\/\">current Department for Trade and Business review of opt-out claims<\/a> to \u201cprovide the cover for giving in to pressure from UK big business, US global players and their advocates\u201d.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>\u2018Global leadership\u2019<\/strong><\/h3>\n\n\n\n<p>Gutmann described recent attacks on litigation funding as \u201cgrossly ill-informed\u201d, particularly over the row between <em>Mastercard<\/em> class representative <a href=\"https:\/\/www.cdr-news.com\/categories\/third-party-finance\/funder-seeks-judicial-review-of-merricks-distribution\/\">Walter Merricks and his funder<\/a>: \u201cWithout them there is no regime. Let\u2019s get real \u2013 justice costs. Redress and enforcement costs. The idea of government funding, however arms-length it might be, is simply ludicrous in the present political era.\u201d<\/p>\n\n\n\n<p>\u201cRipping off consumers, done maliciously or not, with knowledge or not, is baked into consumer society,\u201d he said. Class actions were \u201cthe last chance to right a wrong when all else has failed\u201d. As well as helping consumers who may not be aware of the harm done or the redress available, they also stop \u201cthe bad market behaviour of powerful actors\u201d, which would help markets: \u201cCompetition depends on consumers being able to and making choices, which in turns requires that consumers are able, knowledgeable and willing to do so.\u201d<\/p>\n\n\n\n<p>Companies should not be punished for becoming dominant by being successful, but \u201ccan and should be punished for abusing that dominance to harm consumers\u201d, he added.<\/p>\n\n\n\n<p>Gutmann raised concerns about the &nbsp;distribution of settlements and damages to UK class members, but was confident that would improve over time, and echoed recent concerns about the physical and staff capacity of the CAT.
